Pursuant to the report, the Committee focused its attention on "increase of the quality of judicial system, harmonization of the national legislation in the sphere to the international norms and standards."
The Committee held 8 sittings and scrutinized 68 issues.
The Verkhovna Rada adopted during the seventh session the following laws, scrutinized by the Committee on Justice as a specialized committee:
"On Amendments to Chapter ХІІ "Final Provisions" of the Law of Ukraine "On the Judicial System and the Status of Judges" regarding transfer of cases on welfare payments (No2748-VI from 02.12.2010). On September 9, 2010, the Constitutional Court of Ukraine passed the resolution on the jurisdiction of cases on the welfare payments, therefore, the bill (Reg. No.7148) presents a new version of paragraph 11, item 1, chapter XII "Final Provisions" of the Law "On the Judicial System and the Status of Judges", and provisions of sub-item 2 of sub-item 3.6 and sub-item 10 of sub-item 3.7 of item 3, chapter XII "Final Provisions" on the jurisdiction of the administrative court that withdraw the disputes on assignment, calculation, re-calculation, receipt of pension payments, welfare payments for people with disabilities and other welfare payments from the civil jurisdiction. These disputes are transferred to the respective administrative courts for legal review in accordance with the Code of Administrative Legal Proceedings of Ukraine. The statement of claims and appeals on the disputes submitted before October 1, 2010, the legal proceeding of which has not commenced yet, are transferred to the respective administrative courts;
"On Amendments to the Law of Ukraine "On Enforcement Proceedings" and several other Legislative Acts of Ukraine to enhance the compulsory execution of the resolutions of courts and other bodies (officials)." The Law presents a new version of the Law "On Enforcement Proceedings", and amends the Civil Procedural Code, the Economic Procedural Code, the Criminal Code, the Criminal Procedural Code, the Code of Administrative Proceedings of Ukraine, the Laws "On Public Enforcement Service", "On Banks and Banking", "On Payment System and Money Transfers in Ukraine" to enhance the compulsory execution of the resolutions of courts and other bodies (officials).
The Law "On Public Enforcement Service" sets the terms and the procedure of implementing the resolutions of courts and other bodies (officials) subject to compulsory execution if not implemented voluntarily. Pursuant to the Law, the public enforcement service under the Ministry of Justice of Ukraine is responsible for the compulsory execution of resolutions.
A number of bills that have been scrutinized during the meetings of the Committee have been adopted in the first and second reading:
"On Implementation of Resolutions of the European Court of Human Rights, and Practice of their Application" (Reg. No. 6358), which enhances the domestic law on implementation of resolutions of the European Court of Human Rights, and practice of their application.
Under the bill, the public enforcement service shall notify the person concerned about the compensation entered into the deposit account of the public enforcement service, as under the rules of the Committee of Ministers of the Council of Europe, the resolution shall not be considered properly implemented, unless the person is notified about the placing of the compensation onto the account;
On Amendments to Clause 81 of the Civil Procedural Code of Ukraine (re compensation of expenses for the information and technical support of the scrutiny of cases on validation and implementation of the Resolutions of Foreign Courts in Ukraine) (Reg. No. 6407). The bill supplements part 3 of clause 81 of the Civil Procedural Code of Ukraine with a new paragraph 6, whereby the expenses for the information and technical support of the scrutiny of cases on validation and implementation of the resolutions of foreign courts in Ukraine are not covered by appealing to court, but are payable by the parties after the scrutiny;
"On Amendments to the Law of Ukraine "On Amendments to the Law of Ukraine "On the Judicial System and the Status of Judges" (re Special Training of the Candidates for the Office of a Judge) (Reg. No. 7451). The bill improves the procedure of appointing the judges to the office of a judge for the first time; regulates the issues on the training of the candidates for the office of a judge; and supports effective work of the bodies in charge of selecting the judges.
Moreover, the Committee forwarded a number of bills to the subjects of the legislative initiative for elaboration
The Committee submitted its propositions to the bill on State Budget of Ukraine for 2011.
The Committee pays special attention to the citizen´s appeals and during the seventh session more than 4345 appeals were scrutinized and generalized for the purpose of improvement of the Ukrainian legislation.
